  • Can signing a policy compel others to comply?

    Hello,

I hope you can help me...

My employer is requiring me to sign up to an independence policy (as they are auditors) including, for example, not holding shares in audit clients.

However, it also requires that my spouse and dependents (plus others) maintain the same standards of independence.

Is it possible for compliance outside of the signatories of the policy to be enforced in this way?

    Thanks in advance!

Auditors need to maintain their independence and avoid conflicts of interests. I suggest that if your family members hold shares in or have other connections to your clients then you should disclose this to your employer.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

What about those cases where partners have totally separate financial arrangements, and maybe even keep them private from each other?

How is it possible that if *I* sign a policy that *they* also have to comply with its requirements?

It would be helpful if you can please quote the relevant wording.
