    I resigned from a company due to my disability being overlooked and them not involving occupational health for recommendations until months after requesting and also a manager knowing about my issues targeting me and driving me to leave due to mental health deterioration because of the treatment.
    I logged constructive dismissal and after rejection of conciliation by them and also trying to say they were not responsible for their subsidiary ( which was rejected by the court) then saying they needed more time as documents were not recieved and now getting a tribunal date of January 2024 They now emailed saying they want a preliminary hearing as they only have a date of tribunal and not any timeliness or guidance of procedure.
    I don't have representation bit I am unsure as why they need this? They have had the same documents as me and are responsible for the delay.Are they just trying to find our what evidence I have against them prior to the tribunal?

    It sounds like they are wanting a Preliminary Hearing (PHR) to determine the Case Management Orders (CMO) which is an instruction from the Employment Tribunal for all parties to do something by a certain date e.g. the disclosure documents need to be exchanged by xxx date, the witness statements by yyy date.

    Have you been copied into their correspondence to the Tribunal making an application for a PHR?

      Yes they have requested a preliminary hearing and I was copied in by the court administrator

        That is the normal process and in that request have they provided the details for wanting the preliminary hearing (PHR)?
