  • Agency Work, Compulsory Over Time

I work through an agency and have an 8 hour minimum call out on every day worked. I was leaving work when I was told that I shouldn't be finishing because I'm booked for 12 hours today. I said it's an 8hr call out not 12. They responded with 8 hours is the minimum but you need to be available for 12. It's the first I'd heard of that. Surely if they are only guaranteeing you 8 hours then it's a two way street, I shouldn't need to stay for more than 8?

You should refer back to the agency through which you are contracted and ask them to clarify the basis upon which they have agreed your working hours with the company.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I have and was told it's a gaureteed 8hrs but I'm expected to be available for 12 or more if within legal limits. I'm a lorry driver and do regularly do 12-14 hours but also regularly sent home after 8hrs. On that day I just wanted an early finish so was surprised to hear them tell me doing more hours was mandatory even though the guaranteed hours is only 8.

You have the contract you have. There is no substantial reason to expect a balance of expectation.

That rather answers the question. You should have sought agreement that you could finish after 8 hours that day
