  • Notice periods and rota changes

    Good evening,

    I work for a large national company and have just been through a national rota change. When our department started theirs we were called in individually, by a junior manager and were asked to choose 3 rota lines, 1st 2nd and 3rd choices. 5 or 6 weeks went bye with no other consultation. In mid December we all received letters stating "thank you for attending your second one to one" the rota we were being put on to was at the bottom.

    I am told they have to give us 12 weeks notice period and that needs to be explained in the first brief/ consultation. Nobody was told we were on notice and a lot of my colleagues feel cornered into doing rotas they don't want and haven't had the opportunity to discuss with senior managers.

    My question is: is this legal? Are we in a position to challenge this legally? Or are we stuck with the rota's we have been given?

    Was the national rota part of any trade union negotiation?

    Where did you hear that 12 weeks notice needed to be given?

      The rota change was part of a trade union pay negotiation. We have heard 12 weeks through word of mouth, it's turned into a urban myth, nobody actually knows the truth.

        The issue that you have is the rota change was negotiated as part of a union pay deal. As such any changes consulted and/or negotiated with the trade union will automatically form part of your contract of employment whether you are a trade union member or not.

        I would suggest you need to clarify the terms of implementation for the rota change and notice period for this to start with your union rep.
