My employer is putting me through a disaplinary from footage found during a separate investigation of someone else. I've not done anything illegal just taken a little longer on break and turned a blind eye when people went out for a cig at the end of the shift. Is this legal?

The question is whether you have an expectation of privacy where you were filmed. If it is a relatively public part of your place of work, then it is lawful, but, for example, in the toilets you might expect privacy.
I suspect that they are free to use the recordings.
You can, and should make the objection, but be ready to deal with the substance of the allegations made against you.

Has the company invited you in writing to a disciplinary meeting setting out the details of the allegations and do these contravene any clauses in your contract of employment or policies and procedure?
Were you aware, either my direct communication or a separation policy/procedure, that CCTV was in operation?
