    Hi, on my case management orders by the 4th of July ( today) the claimant and the respondent must agree on documents, The respondent must make a file of these and send it to the claimant. I was asked on the 23th June if i was happy with respondents documents and told he will go to office next week ( w/c 27th and make the bundle. If i ask for more disclosure documents after the 20th June( date of disclosure deadline) does the respondent still have to keep to the sending the Bundle deadline, thanks

      So yesterday was the deadline for agreeing the documents to be used in the bundle which I presume the respondent is then collating? The CMO normally provides a date for exchange of the bundle, when is this set for?

      It sounds like you agreed on 23 June that the list of documents was correct (in advance of the 4 July deadline for agreeing this) and on this basis the respondent set about creating the bundle. Yes, unless otherwise agreed the exchange of the bundle should be on the date set out in the CMO which is normally a few weeks before the WS deadline.

      If you provide disclosure documents after the list has been agreed this is still ok as disclosure is an ongoing process even after deadlines, however depending on how long this goes on for it may delay the final exchange of the bundle as set out in the CMO.
