  • Position made redundant

    Evening all,

This morning i found out that my position is being made redundant, HR & my line manager have said that my duties will be redistributed amongst existing staff that have their own duties to fulfill.
My question is if my duties still have to be actioned by others should my position be made redundant?
Also i know other roles in the company that will be offered are at a considerably lower salary which will impact on my ability to pay the mortgage and bills, is there anything that I can do regarding this?
    Thank you in advance.

It sounds like this is a redundancy situation due to a restructuring of roles and responsibilities. Are you the only person affected?

The company as part of the consultation process has to consider "suitable alternative" roles for you. "Suitable" means work that the person can reasonably do and that is on terms and conditions not substantially less favourable to them. A job on a lower wage or salary will therefore not, technically, be suitable. Nevertheless, an employer is best advised to offer a person being made redundant the option, if it arises, of a less well-paid position, because a failure to do so may turn an otherwise fair dismissal into an unfair dismissal.

You therefore have the option to reject the "suitable alternative" role on the basis that the salary level is considerably lower and therefore is not suitable. In which case the company would have to continue with the redundancy process.

The company needs to prove it is the position being made redundant, even if that is via a restrucuturing of the responsibilities of that job into other roles.
