  • Resigning whilst suspended

    Hi , I have been suspended from work on full pay. i have done something wrong as in refunded myself £50 on the business system which is classed as fraud which I did for a friend and now suspended and still investigating. I am really sad as being suspended until further notice I feel like I will get fired and I don’t want that on my reference so should I resign now or should I wait for the investigation and see their decision.

    How long have you worked for the company?

    You say you refunded £50 for a friend, was there product returned to be refunded?

    If there was product then there is no intent regards defrauding the company.

    Although the company policy would state that you cannot carry out refunds for family or friends. It's a failure to adhere to company policy, I don't think it's Gross Misconduct, you need to have a look at your Employee Handbook to see what it says. Definitely a warning, depending on your previous conduct.

      Employers will often accept an employee resigning before a case is concluded and it can be the best way for the employee to go but it can have consequences if the employee then needs to gain benefit’s etc from the government .

      Employers can however refuse to accept a resignation without notice and then conclude the case prior to the employee official last day of service. This is what may happen if there has been employer loses due to dishonesty.

      What you did can be regarded as gross misconduct but if it was if there was no intent to defraud the company they could give a suspended dismissal .
