    Good Afternoon

    Heres the senario , after 3 months probation my partner asked for the probation to be extended to 6 months (due to having reservations whether the job was right for them or they for the company) and this was agreed and they have the agreement documented . They have since found alternative employment and want to start as soon as possible.
    The contract states a notice period of 3 months and also mentions the 3 month probation period but there is no mention of the notice period in relation to the probation period if that makes sense
    The company are trying to drag their feet with responses
    I would say it should be a week as no where would have a 3 month notice period written into a probationary period ...... would they ?

    It is typical that if the contract states a notice period there is generally a different length of time for during the probationsry period and then a greater notice period after it has been successfully completed.

    A three month notice period during probation is not the norm and seems a bit excessive.

    Statutory notice would be one week.
