    My company went through a reorganisation, they gave someone else my position and put me in the redeployment pool saying there were no positions at my grade that I could apply for, I was 55 with 21 years service, and asked for redundancy and my pension. They said it was too expensive and immediately forced me into a lower grade position (different title) doing the same work at a what they say is a lower skill level (but it's the same position really). I refused it but they said they will not accept that refusal and that they will protect my wages for one year in order for me to find another job and that I am still in the redeployment pool in the interim. I asked why I had been demoted they said my interview was bad, I asked for written feedback which they refused to give me for 3 months, eventually I got it to find they had deliberately scored me badly. I asked for an interview, proved this and they admitted verbally that they had but that they would not apologise. The redeployment pool is offering me positions based on my skill level and cv but I cannot apply for them because the feedback my employer gave me is so detrimental. This all started a few years ago because I blew the whistle on a manger for bullying, I won my grievance then they immediately put me on a 2 year PIP while my husband had cancer (I won this if you can say you won a pip) but I think I need to take out another grievance and am tired of it all. I don't want to have to leave with nothing after 21 years can anyone offer any advice pleas

        Before I can provide a response to your situation I need to ask some further questions:

        When did this reorganistation take place?

        What consultation process did the company go through in regard to removing you from your position?

          It took place in Feb but they only gave me the contract last Tuesday, They gave me the new job description last Friday after I threatened them with a grievance over the incorrect feedback they used to demote me, there was no consultation.

            I've told them I'm working under protest I saw it on an acas site because they have told me last feb I was on a lower grade but took 4 months to supply paperwork

              When did you let them know that you were working under protest - back in Feb or only once you received the new contract?

                Back in Feb when they first told me and again last week when they finally gave a a contract to sign I said that I'd hand in my notice and leave when my protected salary ended ad they were only giving me that for a year because they knew they were breaking the law. They never got back to me so I'm in limbo again. I put in my grievance and am meeting them on 29th of this month

                  I wrote this I think it was ok

                  Today is 03/09/21 I received the written contract on 01/09/21 my reply is similar to the initial reply I gave on the 30/04/21 after the meeting held outlining this proposal.



                  I still maintain that this role is not Suitable Alternative Employment, that this is a redundancy situation and that I have been removed from my role of Senior Technician (Grade 5).



                  The consultation process which we are currently entered into has not yet reached a satisfactory conclusion, more so by the recent written feedback received to justify the outcome presented to me.

                  Perhaps if I had received all of the information listed above sooner (unfortunately 3, and in some cases 4 months have elapsed before my contract, job description and feedback was provided to me I may have been in a position to comment further during earlier meetings.



                  As I have explained above the grade 3 role is not Suitable Alternative Employment due to the significant drop in salary, grade and status from my current position. As the sole wage earner in my household the Grade 3 position would affect both my earnings and pension too much financially.

                  The fact that you have chosen to protect my salary means that you are more than aware of this.



                  Regarding the contract supplied this is the first time I have seen this actual document and certain aspects of the document do not marry up to the conversations I have had with the above parties.

                  I have still not received a fully accurate written job description attached to the new role provided which has unfortunately again left me in a position where I have been and will continue to work under protest and I will be working without prejudice to my right to make a legal claim. I am working under protest to mitigate my losses as XXXXXXX are refusing to honour my redundancy payment.

                      Do not worry it reads fine.

                      What you need to do now is spend time getting yourself prepared for your grievance meeting. Start making notes of the issues and points that you want to get across.

                        I'm doing that now the stress of it all made me ill and my doc signed me off for a fortnight, it's given me time to chill a little and think straighter.
                        I think I'm ready for them.
