  • Unpaid Overtime??

    I’ve been working in retail for about a year. I recently got promoted to a shift manager position. It’s low level management and I am still an hourly employee. I have been having issues because boss says that managers are sometimes required to work more than 40 hours because in the job posting it says “must be available 24/7, 365 days”. BUT they don’t authorize overtime and told me that anything over 40 hours would be unpaid. Is that legal?

    you need to read your contract see what it states.

      Contract? I signed a job description but no where on the job description does it state that I will have to work unpaid overtime.

          My concern here is that you have not had a contract of employment. I presume that the job description merely sets out the roles and responsibilites of the job that you are doing, it is highly unlikely to set out the contractual terms upon which you are employed.

          Does the company you work for have an HR department? If so i would suggest that you contact them stating that you have not received a contract and now you have been newly promoted you would like to be sent a copy.
