    Hi all,
    I work in a warehouse doing a very labour intensive job that requires carrying and loading heavy items and am on my feet for the full duration of the working shift. I work nights with my shift starting at 10pm. My contract of employment says that I am entitled to 2x30mins break taken during the shift. The first break is taken between 1am and 2:30am and the second was taken at 4am. The company have decided to move our second break to 5:30am so that we now go home at 5:30 instead of 6am.

    In short;
    What we used to do - 10pm start, 30min break between 1am and 2:30am, 30min break at 4am, go home at 6am.
    What we now do - 10pm start, 30min break between 1am and 2:30am, go home at 5:30am.

    This leaves me feeling more fatigued during the shift. When this change was implemented it was discussed with our union but not with the workforce so we didn't have any say on the matter. When speaking with HR, they say that it is to our benefit because we get to go home early.

    I realise that we are getting our minimum entitlement with a 30min break but can the company move our second break to 5:30 immediately before we go home?

    Employers can dictate when employees take rest breaks in work time, however my understanding is that for example if you had one break it should be taken in the middle of the shift and if more than one spread through the shift. They should not be taken at the beginning or end of the shift.

      Thank you for responding.
      I want to challenge their decision to move the break time to the end of a shift, or at least give people the choice of when they have their second break.
