  • Job eliminated whilst on rotation

    I just found out that my job role was eliminated while I have been on rotation I the same function. My rotation has been extended for another 6 months but I will be made redundant if I don't find another role by then.

    Apparently the job elimination took place last year but I was never informed by HR and still haven't officially been told. Any potential for me using this for a settlement?

    1. How long have you been employed by the company?
    2. What type of contract are you on?
    3. I am not sure what you mean by being on rotation. Please can you explain this process as it works in your company?

      Hi I am a permanent employee with 7 years service. A rotation is working in a different department for an agreed period of time to gain experience of a different part of the business. Line management remains unchanged and my line manager made my role redundant whilst I have been on rotation and I have never been informed by him or HR. My rotation has now been extended for 6 months and at the end if I haven't found myself a new job I will be put at risk.

      The background to this is that my LM bullied me. I complained but nothing happened so I arranged this rotation to get away from him.

        If your permanent position was made redundant then in my view, even if you were temporarily in another department for a specified period, then the company should have undertaken a consultation process either collectively or indiviudally depending on whether this was part of a large redunancy programme. This is because effectively the position you were retuning to after your rotation was no longer required.

        The outcome of that consultation may have been to offer you an extension to the current role you are performing on rotation as a potential suitable alernative position.

        Have you raised this with HR, if not I suggest you do that in the first instance and see what they come back with.

          Thanks for your advice. I f I do have to go into consultation is this an error that would this work in my favour if I end up taking a legal route?

            If at the end of the extended period you are make redundanct and a meaningful consultation does not take place then potentially there could be a claim for unfair dismissal.
