    I have suffered disability discrimination from a huge company I have worked at for 11 years. I have submitted an ET1 and they have not replied with the ET3. I’m awaiting the judges response. I was still employed and off sick as they couldn’t make adjustments for my disability. Since then I suffered more discrimination and was advised come back and do 2 hours a week or leave. I left due to constructive dismissal but the judge won’t know this, should I wrote in. I’m a little lost.

    At section 8 of the ET1 did you tick 8.1 "I was unfairly dismissed (including constructive dismissal)"

    At 8.2 you are asked to provide full details of the claim including dates and events. It was here that you should have detailed everything that led up to resigning on the basis of constructive dismissal, including the date when you resigned. If you did not provide this information here, how did you actually respond to this section?

      So at the time I had filed my ET1 for disability discrimination but still employed, I was not in work for 6months as they had removed my adjustments and had no job for me. My doctor is signed me off. I tried once more with company after grievances for adjustments and they made it impossible so I had no choice to leave, due to constructive dismissal.

        If what you have detailed in your post #3 i.e. "....they made it impossible so I had no choice to leave, due to constructive dismissal...." was in secton 8.2 as part of the details of your claim then yest the judge does know you left due to constructive dismissal because you have stated this.
