  • Desciplined on hearsay with no witnesses

    Hiya, ive been told I am to be desciplined on something i am supose to have said that could lead to my termination of employment. There were no witnesses to this claim and I am denying the accusation as simply untrue. I was suppose to have made a negative comment about a form and have told my accuser that I will lie on the form. I did not say this and I did not lie on the form. I am just a little off of completing 2 years. I should say this is the 3rd time in as little months I have been investigated by hearsay remarks that cannot be proven. It appears I work for a tittle tattle form that encourages reporting. I can honestly say I did not say these things and on one occasion what I did say had been twisted and distorted. So my question is; can i be fired for something I sent saying and there were no witnesses? And can i take my claim to the tribunal given I am just a week away from completing 2 years

    The company should carry out an investigatory hearing prior to a disciplinary.
    Perhaps they are not following their own procedures?

      Couple of questions to ask:

      1. Do you know when the disciplinary meeting is going to take place. You should be formally notified of the meeting, provided details of the allegation/s provide any evidence the company is going to rely on, give you the right to be accompanied and details what the outcome may be if disciplinary action was to be taken.
      2. If you have a date for the meeting when is that due?
      3. What is your notice period as stated in your contract?
