  • Reasonable Adjustment

Work for a large corporate. Have an illness that’s covered by the equality act 2010. Have requested a reasonable adjustment to hours/days by compressing and needing beginning of week off, so have 3 days together to recuperate. HR have referred me to Occ Health, they’ve responded supporting this request, HR have dismissed the report as useless and have now referred me to an independent medical professional. Adjustment request is not being supported due to business needs. Advised the job is 20 hours over and above my contracted hours which is expected. Any assistance would be great fully received. Based in Scotland.

I believe the application of the Equality Act is the same in Scotland as in England which is where my experienced is based.
I presume you have not had the independent medical referral yet?

If you are covered as disabled under the EA then your employer needs to consider requests for reasonsable adjustments and be able to justify any reasons why they will not make any such adjustment or explore other alternatives with you to those requested. This is particularly relevant if they are supported by an Occ health report and maybe potentially an independent medical practioner's report.
