    Hi. I'm working in a warehouse and since this covid started the company is trying to input a lot of health and safety new rules. For ex: they closed the smoking area that was inside and now all smokers have to go outside of the company to smoke. The last email from operation manager was saying that everyone who are staying in group, smoking ( of course without wearing mask) and without social distance in front of the company, will be suspend.
    My story is: in one morning, before my shift started, I met one colleague and she was smoking a cig(not in front of the company) I was keeping distance and wearing mask as I'm pregnant. Another colleague come to say hello ( same with distance between us and she was wearing mask as well) and the lest colleague finished her night shift and came to greet 2 were smoking, 2 wearing masks. All of us with social distancs between us.
    Second day, my flm came to escort me outside of the company as someone report for not keeping the health and safety rules.
    ​​​Ans now I'm suspended, waiting for investigațion.
    Question: if I was before my shift are they allowed to suspend me?
    We were keeping distance and we weren't in front of the company.
    This suspension because of this reason I feel it like humiliation, and because I'm pregnant, can I put a grievance against hr?

    Firstly your employer was breaking the law by still having an indoor designated smoking area prior to Covid, the law around this has been in place since 1 July 2007.

    Secondly the email from your operataions manager has made it very clear what they expect of people who are smoking outside and the outcome of not complying.

    The only reason you may be able to try and relate anything to your preganacy is if the other members of the group were not suspended also. If you were all suspended then effectively you have all been treated in the same way so you would not be able to raise a grievance about your suspension purley based on the fact you are pregnant.
