  • Paid weekly but Payroll monthly?

    Hi everyone,

    Im a bit stumped on this issue to be honest. I left a job about 4 months ago and never received my last week pay from them, i and my colleagues there were all paid every 2 weeks, so you work a week and then get paid for it a week later. Upon many requests to be paid the hours I worked, nothing was received so i went to acas for conciliation. I was then told that i had actually been over paid, to which i disputed this. Now i never actually received a pay slip when working there despite asking many time. it was only 5 weeks after i had left that i received all my pay slips all at once.(they denied this and claim a pay slip was given monthly. Luckily i have picture proof of all the pay slips coming at once 5 weeks after i had left)

    The pay slips do not include rate of pay or hours worked on them either, so i had to dig back for months to find out the hours i had worked and use the gross figure on my p45 to get the hours they claimed i had worked. (this was worked out from the £10 per hr wage)

    This dispute has gone on for about a month now, and despite providing information that the pay slips do not reflect hours worked (pay slips state i worked 441hrs whereas i actually work upwards of 600) even proving that i am actually severely underpaid. They are still denying that i am owed money and still insist i have been overpaid. Even asking why i did not question my pay when i worked there despite the fact that i never received a pay slip. I did question pay a few times and even got a text response from the boss giving me an very unclear answer.

    In the final email form Acas, the company then stated that i was actually paid monthly but was given advanced payments to ''cover my costs'', however none of this was discussed and nor was it contractually agreed since i never had a contract from then despite requesting one.

    I have spent many hours proving to them that i had worked over 600 hours and that an overpayment is a false claim, even using the weekly transaction in my bank account and google location tracking to solidify my proof, but they still deny all of this. Has anyone ever heard of payroll running monthly but employees being paid every 2 weeks or a week in hand as some say? Also, do they have the ground to get this so called ''overpayment'' back if can prove my location during months worked despite not having a contract from them?

    P.S, It's not just myself this is happening to, a colleague who left the same time as my is also having the same issues with the company claiming overpayment from him as well.

    Any information would greatly appreciated as i am absolutely lost,

    I just need to understand where you are in the ACAS process since you only have 3 months less a day from the instance of the suspected underpayment to be able to raise an Employment Tribunal claim for unlawful deduction of wages

      Since my initial post the acas process has ended, it got to a point where conciliation was never going to lead to a settlement and essentially had come to messages being sent back and forth with no end in sight.
      The messages i recieved from the employer contained more and more information that was never discussed or written during employment and they had even lied that payslips were provided on time. I now have a certificate for an employment tribunal and i believe a month to start a tribunal.

        The certificate will provide the details of when you need to make an ET claim by.

        If you are claiming underpayment of wages this is considered to be an unlawful deduction of wages claim. You will need to detail in full the hours that you have worked and what you have been paid and consequently the disputed amount of non paid wages.
