  • Confusion About Employer

My husband has worked for his current employer for 34 years.

Up until recently, a few weeks ago, the company moved business premises.

Rather then admit it was a company shut down, to avoid paying people for this the boss said he wanted people to take 1 week off for maintenance.

During this week off, staff were suddenly sent a letter informing them of the company move, only giving staff 1 weeks notice.

The concern we have is that last night, we discovered on Companies House, the company has also suddenly in April, changed its name., and has not informed staff according of the new company name either.

No one of the staff have been offered a new contract of employment either, which should include the new company name.

We believe that the company move, and subsequent change of name, was to avoid paying tax, but also avoid paying debts, as debt collectors have been at the old premises asking where the company has moved to.

Any advice? Surely with a change of name employees should be given new contracts!?

It's been a change of name but still the original company number so still the same company. They won't be avoiding tax as it's the same company. Avoiding debt collectors maybe but only for so long.

As an administrative process back in April the employees should have been sent a letter stating that the company name had changed to xxx effective from xxx and that the terms and conditions of employment under the company name of xxx remain unchanged and they have continuous employment from the date of the start of their contracts with the original company.

In regard to the premise move how far is this from the old premises?

How much notice were staff given in regard to the required week's holiday as they should have been given double the notice i.e for a 5 day period of company required holiday they should have been given 10 day's notice.?
