    I have just been made redundant and they have told me that for my notice pay I would only get 80% of my salary rather than 100% because all staff have been on 80% and will remain on 80% for the foreseeable future...they also mentioned I will only get 80% because my contractual notice period is 1 month and statutory notice period is only 1 week. If they were the same I would get 100%.....does that sound fair to you? And whilst I have been on furlough they have taken 2/3 of my annual leave entitlements every month they put me on furlough on top of having to take 40% of my annual leave by end of june, are they allowed to do that and have all businesses have been doing the sam to those on furlough do you know as I am now left with hardly any accrued holiday entitlements, can I push back on these?

    I presume that you have less than two years service since the company has stated that statutory notice is only 1 week is this correct?

    Did you agree a variation to your contract to be placed on furlough at 80% of you salary?

    Given the current circumstances and unclear guidelines from the government the current view is that if your contractual notice period is at least one week longer than the statutory minimum, which in this case it potentially is, then you will be entitled to your contractual notice pay at 100%. However, this may be reduced to the 80%, depending on the wording of the employment contract or furlough agreement. So please can you confirm if you did sign a furlough agreement was their anything about rate of pay for any period of notice.

    In terms of leave so long as the company gives you double the amount of notice for the time they want you to take as holiday this is legal. So if the company requires you to take 5 days holiday they need to give you 10 days notice.
