    Hello.

    I handed in my (three month) notice last year but I couldn't find a job I liked and as they didn't replace me I am still working for them.

    After my notice ended I did ask my boss if they would allow me to take back my notice as it seemed I could just leave with no handover or they could just tell me to stop working which seemed a risk for both sides. He said they would 'extend my contract' to November, but this was over the phone so there is nothing written.

    A colleagues has suggested that technically I am back under a contract as it will be nearly a year since I handed in my notice and nothing really has changed, would they have to give me three months to tell me they no longer wanted me (I am not after redundancy, just need to ensure I have work somewhere)?

    Given the situation you need to speak to your employer about the status of your contract. Given that you have not left and continued to work for the company I would suggest that you may still be under your original contract but you need to check this with them.

        I would suggest that you can say that given the absence of anything in writing to the contrary and given you have continued working and the company has continued paying you in the normal way since last year then your employment contract has effectively continued.
