Redundancy shortfall

Did the new owners buy the business from the previous owner and were you TUPE'd across to the new owner, it sounds like you should have been.
If that is the case then when you transferred to the new owner under TUPE, your continuous service continues to run from the start of your employment with the previous owner. This means that when calculating redundancy the new owner needs to take your original start date with the old owner. Even if you signed a new contract and agreed to different terms commencing on the date of that contract then your continuous employment would be your original start date
The maximum statutory redundancy calculation is capped at 20 years service. If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
