Hi, I hope you can help. I'm currently going through a 30 day consultation period and not getting the answers to my questions at the consultation meetings. What happens if the consultation period ends without me agreeing to the terms? thanks

What terms have you been given?

If you have worked at the company for more than 2 years you will be entitled as a minimum to a statutory redundancy payment which if you want to check the calculation you can do so on the government site:

4 week's is the notice period. When the consultation period ends and the role is confirmed as redundant, it is common practice to make an employee work the notice period? At the last consultation meeting do you need to sign any paperwork? If you aren't happy with the settlement package what rights do have if you reject it?

In answer to your questions as you have asked them:
1. An employer can chose or not for an employee to work their notice period. They can pay you in lieu of notice if they do not want you to work it.
2. It is not necessary to sign any paperwork, however at or soon after the meeting you should get a confirmation letter that you have been dismissed due to redundancy. It should confirm termination date, payments and if your company is following good practice the right of appeal, although this final point is not a legal right.
3. You have not said why you are unhappy with the terms you have been offered, so it is difficult to provide any more guidance on that point. There is a statutory redundancy payment which i have given the link for you to check what you are being offered, alternatively your company may have a policy that enhances the redundancy payment, if so is your payment in line with that formula, or have you been offered a package which is outside of these two options, if so are there any specific reasons for them doing so?If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com
