    Hi

    I really need some advice asap! I work for the nhs and a. currently shielding. On Thursday completely out the blue I had a phone call from my ( new)* regional manager informing me that I have been suspended on allegations of gross misconduct.* To say I was shocked is an understatement, I've never had any blemish on my records. During this time I have been working from home mainly doing outstanding work on patients records sono face to face work. I spoke to my previous area manager about an area I was working on & she said I could use historic bp readings if they were within range in.the past year...so this is what I did. I also added the same patients into various clinics as I constantly had to re do work due to a computer glitch which both my manager & area manager were aware off. I have now been told that doing these are considered gross misconduct despite only doing as I was asked & documenting the original date of the readings. I have a disciplinary meeting on Tuesday However I can't ask anyone to attend as I can't contact anyone. The stress and anxiety felt has been immense & I have no physical proof of my innocence!! Any advice would be greatly appreciated x

    Shielding doesn't prevent you using zoom the phone or similar.* You're in the NHS so you should be in union. Ring them. Do you have evidence of the calls regarding what to do or the doctor you reported th e computer glitch. With luck you will have an email trail.*

      It is gross misconduct to refuse to carry out a lawful instruction from your superior(s).

      If I understand the facts correctly, you, having obtained advice on what you should do, from your previous superior, carried out that advice. Your present superior says that by carrying out that advice you are 'prime facie' guilty of gross misconduct.

      The question you will have to answer is why you did not seek advice from your present superior.

        Firstly you said you spoke to your then area manager about what you should do and she indicated historic BP readings were fine, do you have this in writing or any evidence that can support the instructions you were given?

        Have you had formal notification of the meeting with the copies of any evidence that will be relied on at the meeting to support the allegations. I appreciate that whilst on suspension you are not normally allowed to contact colleagues, however if you wish to be accompanied there is no reason why you cannot contact the person who will conduct the disciplinary hearing (who should have been named in the invite to the meeting) in writing and ask them to arrange for xxx to be allowed to accompany you.
