  • Laid off before others

    Can anyone offer some advice on being laid off after furlough. For example a well known company has let the longest serving employees go back to work first which is fair. If this company needs to lay people off the employees who have been there the shortest time will go first. Also very fair. What if you have been furloughed yet another employee with same job has been taken back before you yet you have been working there longer? Then they need to lay people off but it's you laid off and not the employee they have taken back. This is within a company that normally follows the last in first out rule. Does this give me any rights for complaint or legal action? Thank you

    Do you have a lay off clause in your contract of employment or if not was this written into any new agreement you were asked to sign when you were placed on furlough?
    Could you not be asked to be be placed back on furlough?
