    Hi Guys just looking for sts looking like ome advice my son works for a small distribution company it only as 4 employees and he is the only employee placed on furlough now after speaking with his boss its not great news as she as stated its highly likely he will be made redundant this is where the confusions comes as my son as been with the company from day 1 so it looks like it's 1st in 1st out is this discrimination or is it upto his boss who she wishes to make redundant personnally i find it disgusting thanks guys any advice

    A redundancy arises because the requirements for an employee to carry out work of a particular kind in the place where they are employed has or is expected to cease or diminish. Is your son the only person doing that role or do any of the other 3 staff carry out the same role?

      My son as been with company 6 years and all 3 do same roles

        Thank you for the information. If all of the staff are doing the same job then the employer is going to have to start a redundancy consultation with all of them. In a nutshell this means that there will need to be a meeting with everyone affected to explain that there is a need to reduce the number of people doing that role. They will all need to go into the "at risk pool" and then the employer will need to create a selection criteria against which all staff doing that role will need to be assessed. The person with the lowest score is then the person selected for redundancy. In the meantime as part of the consultation process the employer needs to have a discussion about whether they have any suggestions to try an avoid the redundancy situation or look for a possible alternative position in the company.*
