    Good morning all,

    I hope all is well.
    i am subject to a disciplinary hearing as a security officer on a 24 hr a week contract working on different sites. Iv been employed since feb 2019.
    it started on a site where I was deployed. The allegation is that I left site with out informing the control room for a few hours I’m adamant I went on a 25 min break and came back within 45 mins as I took a wrong Turing and got lost. During the fact find meeting held over the phone i explained as below:
    I have explained “I’m not familiar with area all shops closed went petrol pump took wrong turning and got lost. I contacted the control room once I was lost but there was no answer and it was not a couple of hours but 45 mins”
    They have written back 4 weeks later saying a disciplinary hearing in which I could be given a final written warning. They have sent me a copy of a witness statement and have allege something I totally did not say in the investigation meeting. Thankfully I recorded the meeting as it took place and have explained that they should retrieve calls for this purpose as I won’t accept a final written warning by using a quote from me which I never said. The response was that I should not have recorded it in the first place however I can send him transcripts of what I have recorded prior to hearing.
    How should I proceed ? I’m not part of a union and will be very keen to hear advice on this.

      Is the recording of meetings expressly prohibited in any policies that the company has? In which case you could be guilty of a separate act of misconduct for which you could be disciplined separately. You may just want to check this out.

      If the recording supports your version of events and is important in helping your defence for the disciplinary hearing then it would probably be to your benefit to have the recording transcribed.

        Ok thank you very much ULA for your response. I have not had a chance to check back since then so couldn’t get back earlier. I have spoken to a senior HR person and they have persuaded the people in the investigation to allow a transcript of what was actually said by me.*

        I have since joined a union. My*last hearing was adjourned as I had provided proof of the phone call which was made with a screen shot but the manager wanted me to show the call on the “call log” which due to a technical error I couldn’t do. I’m trying to locate the phone engineer to rectify the issue but he’s proving very difficult *to find at the moment. I have to find a way of proving that I made the phone call and have explained that because I cannot afford a good quality phone they keep breaking down on me and I can’t get hold of the evidence which he is*not *ready to accept. Even though the person taking notes from HR explained that “ If I could show a list of calls made from the phone provider to match the date and time I made the call”*which the manager dismissed as not acceptable evidence.*

          You will need to do as much as you can to get hold of the evidence in regard to the phone calls as this will be helpful in your defence. Maybe you can contact your network provider and they can give you a breakdown of calls made for the evening in question.

            If you were calling a main company phone and they have caller display or stored memory some phones will show last 20 calls some* phones 200 or more missed calls your call could be found but you need to request they check and show you they tried to validate you called so it is a long shot. Also did you have sat nav or does the presumably company car have a sim or tracker on it I know security companies do use them it could prove where the car was and you had not popped off for a jolly as it were but in* thisarea Hopetrying to get back to your post.Hope this* helps

I will take the advice given to me and provide a response to the company and see how I get on. I’ll return to this thread and contact the union to seek further advice regarding my next move.*
