    I have been on furlough for 7 weeks but upon returning to work all annual leave is not allowed for previously furloughed staff. I need time off to care for my 2 children when my wife cannot through work. Is there anything I can do?

    Measures were introduced in March regarding holiday leave carry over due to COVID 19 and these were introduced under The Working Time (Coronavirus) (Amendment) Regulations 2020

    These did not change an employer’s right to refuse permission for a worker to take leave on particular days (provided they give notice which is at least as long as the holiday requested). However, under the new regulations, they can only exercise this right where there is “good reason to do so”. Given that you have returned from furlough then legitimately your employer may have concerns about having staff go on holiday for operational reasons.

    I completely understand that you have a childcare issue presumably because your children cannot attend school/nursery at the moment. Have you explained the situation to your employer? How much time off are you requesting?

      Hello Ula, thank you for this reply. I have explained the situation and am only asking for 1 day this week for example. 1 day next week so it is only going to be 1-2 days a week. I have no choice, I need to look after my children during these days. Is there a possible case for discrimination as it only applies to the furloughed staff and not the staff who continued to work.

        The normal rules of discrimination do not appear to apply here from what i can see from your posts

        Can you raise this with a more senior person or HR?
