  • Dismissal & re-engagement plus settlement agreement

    Hi All I am looking for some thoughts and any advice anyone can give for the following:

    * I have been with my with my company 9 years.

    * June 2018 I was recruited to the role of a supervisor all the things I was told I would do including a £1000 increment for completing objectives never materialised.

    * At the time objectives were set I had a temporary manager.

    * As time went on i raised concerns about not completing objectives etc. through no fault of my own my queries were ignored.

    * December 2018 I raise all my concerns with my new manager she stared to look into things but nothing came of it all.

    * June 2019 I raised a formal grievance.

    * July 2019 6 weeks after my grievance hearing I receive a response.

    * Monday 22nd July I ask to see HR and my manager it appears the company is at fault for many things but it is realised I cannot continue in the role due to needing someone with technical experience which I lack.

    I was told the company does not want to lose me and I am offered my old role of a coordinator. My old role starts next week and my wages will reduce by £6k so I am offered £6k as a settlement.

    I have until tomorrow to decide what to do.

    Was the formal grievance based on the concerns you had raised with your new manager?

    What was the outcome of your grievance?

    Are you in agreement with the conclusions that you cannot perform the role of supervisor that you had been recruited for due to your lack of technical experience?

    Effectively the company has offered you the previous role you performed with compensation of 1 years difference in pay between the salary levels of the two roles.

    Are you happy to go back to the old role?

    Have they put any stipulations in place in order for you to receive the settlement, such as you are not expected to leave within a defined period?

      My grievance was based around the concerns I discussef with my new manager and wad submitted after 6 months of continuing to discuss those concerns & waiting for answers that I was told I would get.

      The outcome took me by surprise a lot of it centred around no formal process in place so everything the temporary manager who was employed as a consultant promised cannot be followed through so the company have said that is one area they need to tighten up on.

      I agree I cannot fulfil the role the company have admitted they are at fault they should have made stipulations for the role.

      I look forward to going back to my old role yes its going to hurt it was meant to be the start of my next chapter I tried my best and its a shame that I never had chance to see where it went.

      As far as I am aware only stipulatuon is I cannot talk to anyone about the settlement except with the people they have named.

        The one thing is though that the manager who heard my grievance has belittled me by accusing me of being rubbish at my job and that I have told lies I am at an all time low my stress is through the roof.

          Glad that there are no onerous stipulations surrounding the settlement.

          I would suggest, if you are going to accept the offer, that you request an agreed form of words that if people ask about the situation is used by management, HR and yourself to avoid the issue you described in your last post.
