  • Former Employer is demanding I sign a confidentiality deed

I have received a letter from a solicitor acting on behalf of my former employer asking me to sign a deed to say I shall:

    1. comply with a clause in my contract of employment referring to Confidential Information
    2. If requested, confirm I have complied with the undertaking set forth in the deed.

I am concerned at the threatening tone of the letter and I wish to confirm if they have a legal right to ask me to sign the deed.

You are not an employee any more and therefore they have no rights to ask you to sign. That's my opinion anyway.

Whereas I would say whilst they have the right to make the request, you have the right to decline.

They have no rights as you are no longer an employee, but if you feel that signing will not cause you any problems then you are in a situation where for a financial consideration from your old employer you will sign.

Pick an amount that you feel is fair and make them an offer.
