  • Zero hour and unfair dismissal advice plz?

    Hello I'm asking for advice plz for my partner, basically he's been employed with a company for about 4/5 mths p/t on a zero hr contract, but the employer has failed to pay his staff on time for the last 2mths due to it falling on a bank hol,this month being 2 days after his original pay day which left us really struggling and incuring over draft charges with our bank, now this company runs with a WhatsApp app which is the only point of contact for his workplace regarding questions to the employer /messages to team members etc, but the other day a couple of staff Inc my partner expressed their disappointment (using the fword) in not being paid and how it had left them financially hard up, in no way was these messages relating to the company or directed at the employer but when my partner went in for his shift the same day, he was sent straight home and was told that he was no longer on the rota, the reason being that he had swore on the WhatsApp messenger. What I would like to know plz is, is this an actual sackable offence and also If you can hold the company accountable for any bank charges incurred for returned d/d for wages not being paid on time obv excluding the bank hol.     What does the contract state about payment date if the normal payment date falls on a bank holiday or even at a weekend?

    In regard to the dismissal, being on a zero hours contract means that your partner is deemed to be a work and is therefore not protected by unfair dismissal and even if they were with less than 2 years service an employer can fairly dismiss someone except in certain circumstances.
