  • Supermarket worker

I work for a very well known supermarket and I've been alleged to have breached the data protection by recording a conversation between myself and a senior member of my team, I am being bullied by this person and was scared of what he was going to say, I made the mistake of telling someone and now I'm under investigation, I've not had any data protection training from said company, any advice would be great please

Hi, I have just moved this thread to the employment section of the forum.

Does your company have a Data Protection policy or any other policy or procedure that covers the recording of conversations in the workplace? If there isn't a clear policy, then we have to look at what the Information Commissioner's Office say about data protection and my understanding of that is you can't record a conversation unless there is consent from the person to do so. I would suggest that this is the reason why they are undertaking an investigation.

However, you said that you are being bullied by the person concerned, have you mentioned this to anyone for example HR or another manager? How long has this been going on for and do you have dates and times of other incidents when this person has allegedly bullied you with any witnesses to these events?
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
