  • Bonding Agreement

    Morning all,

    I agreed on principle to a bonding agreement for a training course with my employer. But did not sign an agreement. This bonding agreement bonded me to the company for two years from the start of the training course (the training course was two years).

    I left the company within the 2 years and started paying the money back. I then rejoined the company within a month and stopped paying the money back as was agreed. I had paid back a small amount.

    During my second stint with the company I was then asked to sign a bonding agreement (approx 6 months after re-starting with the company) and 15 months after the training course started. This agreement, stated that if I left within 3 years of the training course finished I would be liable to paying back the money. However the 2 years for the original agreement has now expired. This new bonding agreement ties me with the many from 5 years from the start of the training course.

    I stated my concerns at the time when I was asked to sign this bonding agreement, and signed the bonding agreement in the end. I found it unfair as I agreed to different terms before the training had started.

    I now have been offered another job. Am I legally obliged to make these repayments?

    Unfortunately yes you are required to make these repayments, since although you had concerns at the time you still signed the agreement.
