  • Local Government Pension Scheme

    I have recently been given tier 1 ill health retirement from my current employer and my pension is due to commence from the 1st of February. I have a second deferred LGPS pension for which I am having to go through a second occupational health assessment to establish if this can be paid to me also; my question is given the LGPS is a single pension scheme but devolved to local authority fund schemes how likely is it that having been given tier 1 already the other pension fund administrators will come to some other conclusion? Secondly, given the delay in this process which has occurred can my deferred pension be backdated to the 1st of February or will it only be payable from when I am deemed unfit for work with the other pension fund?

    My experience on pensions is limited, however in regard to the LGPS pension, which I presume is from a previous period of employment not related to your current employer, then you will need to go through their process in order to determine your situation. Each pension scheme has its own criteria when it comes to retirement on the basis of ill health, as such you will need to attend an appointment at an independent occupational health physician or medical expert appointed by the LGPS administrators. It will be down to this expert to determine which tier your situation would apply to. I would hope however, that two independent experts would conclude the same.

    I doubt, but am not 100% sure, whether your LGPS pension can be paid earlier, i.e. the date your current employer's payments commence if they have not concluded their process. I would think it can only be at the point that they have confirmation from their appointment expert that they can then arrange when to commence your pension payments from.
