  • Sub contractor to employee Rights?

    Evening All,

I have recently been told that I am being made redundant. With only just over a weeks notice.
I had currently worked for the company as a sub contractor with a role as a site supervisor. After working as a sub contractor for 2 years I was asked to become an employee on PAYE with the same role.
My final day of employment now will be one week short of being employed for 2 years. Because I have not served 2 years on the books I am not regarded as having employee rights relating to redundancy.
will any of my time working as a sub contractor help with my case in fighting for redundancy.

    Thanks
    Boots

Sorry to hear about your situation.

I presume you either worked as a self-employed sub-contractor or you were contracted via a third party company either way you were not an employee of the company so not entitled to count this time towards any entitlement to redundancy pay. I also presume that your contract of employment gives the date you joined them as an employee for the purposes of continuous employment.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.
