    I started work in July for a well known care charity. Done my training etc and work in a service with 17 other ladies. All same pay etc. We’re all equal no seniors no floor managers etc. We have a manager of course. But we all do same jobs and all had same pay till last month. We do what’s called sleep ins. We start and 7am work till 10pm got to bed in the service and stay there till 6.30 am and finish shift at 8.30. So basically a 24 hour shift. The pay is per hour while we are working in the service. But receive a compensation payment of £30. Then after a recent court case now receive a supplement of £33. I was asked if I would do occasional sleep ins. I said yes. So done my first sleep in. Only received the compensation £30 and £1.26 supplement. Manager raised it with wages no reply. Until new pay slips arrived last week. I’d done 2 sleeps. Got £30 per sleep compensation payment. But appears to have only got £16 supplement. So after lengthy conversations with wages dept and HR. Any new starters that started after April 2018 don’t get the supplement. So basically we’re working 24 hours for less than min wage. There is a formula in place where they work out a supplement but if you’ve done any over time it’s taken away. So I can never earn the same as my co workers. As they get £63 supplement per sleep regardless of hours worked. It is in the hands of head of HR at the moment. And I’ve refused to do any sleeps. My manager understands this. Can anyone shed any light on this. As it’s just a supplement my co workers all get. Do I have the right to ask for same. My manager or my self were NOT informed of this change in sleep ins till my query this month. Thanks in advance.

    Sorry to understand correctly you get paid for the hours you work plus there is entitlement to two additional payments one a compensation of £30 and the second a supplement of £33, which has only recently been introduced, if you sleep in and work the 24 hour shift.

    What you need to find out is why and where it states that staff who joined after April 2018 do not get the supplement. Bearing in mind the court case, if I have the correct one, was a Court Of Appeal decision in July 2018, so this payment has been added as a consequence and was not available until this time therefore I am not sure how they can penalise staff who joined in a period it was not in existence.

    I would suggest that you do have grounds to ask for the same.
