  • Fixed Term Contract

    I would be grateful on any advice with regards to my following query.I have been employed through the same employment agency since Nov 2017.Since my employment began I have been on the same assignment.In May 2018 I was offered a fixed term contract which I signed.I have since realised that the "fixed term contract" has no mention of when the "fixed term" ends.It also appears that I am still employed through the agency on this so called fixed term contract as they are still paying my wages and it is them that I still deal with with any other issues and they also have the agency name on the front of the Agreement and Conditions of Employment Booklet that I was given on the day of signing.Their name is also on the principal statement of terms and conditions of employment.It seems to me that under the Agreement and Conditions Booklet I am working under "companies"conditions but when I read the principle statement under Sec 2 it states that the statement applies to me and the employment agency although in Sec 9 it actually states my place of work which has been the same since I started in Nov "17.Before I go any further I would be grateful on any help in what I have written so far.Thanks

    Agency contracts

    Agency staff have their contracts agreed and managed by a recruitment consultancy or employment agency.

    They usually work on a temporary basis, and the length of their contract will depend on demand from the employer, as well as their availability.

    It will be the agency’s responsibility to make sure their employees’ rights are protected. However, NI contributions and Statutory Sick Pay will be paid by the employer to the agency you work for.

    After 12 weeks’ continuous employment in the same role, agency workers are then entitled to the same rights as permanent employees of the company.
