  • Poundland manager wins tribunal due to flawed investigation!!

There's just no consistency when it comes to deciding if a disciplinary investigation is flawed or not. The manager in the link is deemed to have had a flawed investigation. I had an investigation but it didnt investigate the actual allegations or establish the facts relied on to dismiss me; it was just an administrative exercise so the employer could say they conducted an investigation and move on to disciplinary hearing and then dismissal. But the ET Judge in my case didnt declare the investigation flawed, he simply said it was reasonable of the respondent to rely solely on their own 'alleged 'knowledge which they had prior to any investigation taking place and which had never been disclosed during disciplinary proceedings, was never tested for accuracy or established as fact!
