  • Erudio Problematic clause

I have an old (pre-98) student loan that was transferred to Erudio way back. I am applying to renew my deferment, and they replied asking for more details.

A section of their letter worries me:.’

    Your Deferment Term:
Should your current deferment term expire before your required additional information be processed, your first payment may not be collected but will count as arrears on your loan(s). If your application to defer is successful, these arrears may be removed”

Could Erudio delay and then say I was in arrears on my loan due to this? This would mean I can’t defer in future years and would lose eligibility due to age-related cancellation, etc.

I was thinking of addressing it head-on in my reply—saying if my deferment is still not settled by the time my current deferment term expires—please take the payment, and I will ensure there are sufficient funds in my account to cover it. However, I request a refund once my deferment application is accepted.

But I would prefer not to make this payment if I can not get reclaim it once the deferment is accepted. This is because I am fully eligible for the deferment I am applying for.

Then make your application and provide the further details well before the expiry of the current deferment term

      Hi
wondering if anyone can help me
I have old style Erudio student loans from 97/98

I was meant to defer in Sept 2024 and I have been deferring for over 20 years and never missed one or when I have they have always started taking monthly payments and then I have proved I am under threshold and they have paid it back . I have never had a deferment period when I wasn’t over the threshold which this year is 3500 a month and I am well under. I have been offered various settlements over the years and sought advice and been told not to accept as even if suddenly earn enough to start paying back the monthly payments would not equate to the full amount in the years I have left . I am 46 , at 50 it gets written off

this year I forgot to defer because I never received any reminder, email or letter ….. I suddenly realised it must have been due and then looked on my account. it says the loan has been terminated . I have no access to any info

      I contacted Erudio.
they said because I didn’t defer they have terminated the account and I now owe over 7 grand in full

they then sent a really aggressive email with a list of all the letters they have sent me ??!!!

I have not recieved a single one

I live at the same address and always open my post
I am used to deferring and done it for over 20 years

      what do I do?

advice I have been given on another chat is fill in an old style deferment form on paper and send copies of payslips and write a formal complaint

then continue to do that every year of deferment for next four years till it should be written off

but can they charge interest ?
can it affect my credit rating and can they/ would they take me to court?

isn’t it illegal to terminate the agreement without notifying me
I don’t know how they can prove they sent letters when they blatantly didn’t ?

      any advice appreciated
      thankyou
