    hi. new today looking for advise on statute barred rules..

    in august 2011( last payment made ) due to job loss couldnt pay cap 1 credit card amongst several other debts. debt was later passed too cabot. in feb 2016 received court papers from northampton bulk. i filled forms in stating wasnt sure what debt related to too ( had so many ) and asked for a cca request for original agreement. never heard another thing off cabot or court. then in feb 2019 received another demand off cabot. so i emailed them stating debt was statute barred.

    they replied with the a letter including the original agreement and printout of transactions from credit card and a letter stating. 'as court proceedings were issued however no ccj obtained. due to legal action initiated the account is no longer subject to limitation period

    also stated they were unable to obtain info for cca request in 2016 thats why they didnt reply.

    my question is are they legally right regarding the limitation period even though they chose not to continue with proceedings and i never acknowledged debt was mine on court papers?? thank you for any advise you can give

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
