  • Employer SAR, ICO reminder issued — advice on court action & self-representation

    I am bound by a settlement agreement from a previous employment dispute, which limits what I can share publicly.

    Around a year ago, I submitted a Subject Access Request (SAR) to my former employer, as I believe they hold personal data relevant to ongoing issues I have been experiencing since leaving.

    The SAR response:

    * Was provided late
    * Included sensitive health information sent without password protection
    * Appears incomplete, as I believe further personal data is held

    I raised a complaint with the ICO. After a long delay, they have now responded and confirmed they have reminded the organisation of its obligations. They also advised that I may apply to court to compel compliance, but suggested I seek legal advice first.

    Since leaving the organisation, I have been dealing with ongoing issues that are causing significant distress and affecting my day-to-day life. I believe that obtaining full disclosure of my personal data is necessary to understand the situation properly and to pursue appropriate action through the correct channels.

    I would appreciate guidance on the following:

    * How realistic is it to pursue a court order to enforce SAR compliance without a solicitor?
    * Is self-representation in this type of case generally advisable?
    * Can such claims be handled remotely (e.g. via video hearings)?
    * What are the typical costs involved in bringing this kind of claim?
    * If unsuccessful, would I likely be liable for the employer’s legal costs?
    * Are there any key steps I should take before considering court action?

    Any insight would be greatly appreciated.
