Court Claim from Cabot

Hi all,

1st time poster and someone who wished he'd found this site sooner.

A week ago I received a Claim Form from the County Court Business Centre regards a claim by Cabot via Restons Solicitors for an overdue balance for a store card.

I know that I've not made any payments or acknowledged the account since 2008 so assumed it would be statute barred. As such I wrote that on my defence statement.

Today I received a letter from the solicitors stating that contest my defence based on I did not provide any evidence to back up my statement and that I should withdraw defence and also they are claiming I made a payment on 19th June 2009 - which I know is not true.

Any advice on what I should do next? Thanks in advance.

Acknowledge Claim - within 14 days from Service

Defend Claim - within 28 days from Service (IF you acknowledged in time)

If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
