I have tried to do some research for my parents. Basically, we have been taken to court by our landlord and my parents ignored the first letter (a blue one. My scanner is currently broken so, I can't even post it on here). So, a County Judgement was issued demanding that my parents pay the rent arrears of £5180 including the court costs.
So, what I want to ask is if we can appeal this on the following counts:
~The house is in an appalling condition. Any half decent builder would deem it unsafe. The foundation is very weak due to several extensions having been done on the property by cowboy builders. The other day, the electric shower started leaking in torrents and it was so bad, that it leaked through to the ground floor, and flooded the room underneath, absolutely soaking the ceiling of the room and ruining the carpet. God forbid someone had been showering and there had been a spark..
~The landlord promised to fix things on several occasions which did not happen (they admitted to this and actually reduced their claim from £8000 to £5000). However, the landlords live abroad in Jamaica, have given us a PO Box address and their email address. they do not answer to their emails however for ages. Also, the landlord, their family and a couple of different people are registered to our current address but the court letter states a different address for the landlord. Is this legally aloud?
Is there anyway you guys can help me out here? I know it was stupid of my parents to not answer the first letter but what is done, is done. And also, is there anyway we can arrange instalments if we did decided to pay them back and how would this be processed, etc?
IMPORTANT DATES- Initial letter was issued on 05/08/2014 and the judgment was issued on 15/10/2014.
