  • Amendment of name for court proceeding

    I am being sued by a sole trader since December 2011 regarding damage to his property. The claimants insurance company have taken court proceedings in March 2013 under fast track. Initially the claim was under the claimants sole trader company say Joe Bloggs of 123 High Street, London. However in March 2013 the court proceedings was logged as Joe Bloggs Ltd of 97 Oxford Street, London.


    After some investigation I discovered that Joe Bloggs Ltd is a non trading company. The claimant solicitor recently picked up on this in February 2014 and requested amendment of the company name to the courts, stating he had made a simple error in the company name by placing ltd. However, it is not just the name but the trading and register address of Joe Bloggs Ltd is totally different to the sole traders address. This can not be a simple error.

    I know for a fact that the claimant had intentionally mislead all parties in order to evade the consequences of losing in court. The claimant is a director of 13 very profitable companies and has 2 other non trading companies with very similar names.

    I have requested a telephone conference hearing regarding change of name. I would like to know:
    1) Can I stop the claimant from amending the details as it is 2 separate companies
    2) Can I get the claim stuck out and request that the claimant starts courts proceeding from the beginning with the correct company name and address
