  • County Court Claim Form Lowell

    Hello,

Please note that I initially posted this in the 'welcome' forum. Realising my mistake I have re-posted here as unable to reassign the original post.

I hope you can help me with this. I have received a county court claims (Northampton) claims form. Here are the details:

    Received a claim? Yes
    Issue Date: 8th August 2019
Have you Acknowledged the Claim?: Yes
    Total Amount Claimed : £900
Claimant’s Name: Lowell Portfolio I LTD
    Solicitors Firm: Lowell Solicitors Limited
Original Creditor: Capital One Credit Card
    Original Debt Credit card:
    Particulars of Claim:
    1) The defendant opened a Capital One Credit Card regulated consumer credit account under reference xxxxxxxxxxxxxxxx on xx/xx/2015 ('the agreement').
    2) In breach of the Agreement , the Defendant failed to maintain the required payments and the Agreement was terminated.
    3) The Agreement was later assigned to the claimant on xx/xx/2017 and written notice given to the Defendant.
    4) Despite repeated requests for payment the sum of £xxx.xx remains due and outstanding. And the claimant claims
    a) The said sum of £xxx.xx
    b) Interest pursuant to s69 County Courts Act 1984 at the rate of 8% per annum from the date of issue, accruing at a daily rate of £0.xxx, but limited to one year, being £xx.00
    c) Costs

Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): Yes
List any letters you have sent (eg: CCA/ CPR ): CCA & CPR
Any Other Information or Background Details:

I have sent the CCA & CPR but need help sending the defence to the court. If you can help with this then I would really appreciate.

If you can also advise me what the next steps are a) if they do send all the documents and b) in the case they do not.

    Thanks in advance.

    Regards,

    Akshay
