  • Refusing to pay FPN - likelihood of being taken to court?

Hello, the other day I was issued an FPN for littering a cigarette butt from a 3GS officer (working for the council). I was not smoking and did not litter a cigarette butt. The enforcement officer had body cam footage strapped to her chest.
I appealed my FPN , however my appeal was rejected and 3GS were insistent that they issued the FPN correctly. I do not want to give in and pay for an offence I did not commit.
how likely are the council to take this to court if I do not pay?
They have body cam footage from the enforcement officer which will display our interaction as she alleged me of committing the offence. Obviously as I did not commit the alleged offence there will be no video evidence of me committing the crime (‘littering a cigarette butt’), nor no cigarette butt of proof on her body cam.
