  • First Tier Tribunal - Requesting that a hearing is rescheduled

    Hello,

    I recently received notice of a hearing date for a First Tier Tribunal in which I am the second respondent.

    This is the first correspondence I have received from the Tribunal since I was directed to provide evidence back in May 2024. No further directions were included within the directions request for evidence and no other directions from the Tribunal Judge have been provided in the interim, which I was expecting.

    I am out of the country on the date of the hearing and have written to the court to confirm this, provide evidence of flights and hotels and requested that the hearing is rescheduled.

    Question 1 - have I followed the correct process to request a reschedule or is there something more formal I should do? I've read The Tribunal Procedure (First-tier Tribunal) (Social Entitlement
    Chamber) Rules 2008 and cannot see any reference to other action I should take.

    I have also questioned the lack of directions in the interim period. My address being used by the court is incorrect and doesn't align with that used on the appellant's application and previous evidence submitted, something I raised with them last year, but the hearing notice was still incorrect. I have raised this with the court again and asked if I have missed any directions due to their error.

    Question 2 - in a First Tier Tribunal, would the district judge normally direct the respondents to respond to the appeal by a certain date in advance of the hearing date being set? Having not had the opportunity to respond, I have said to the court that this would be prejudicial to my case should the hearing go ahead.

    Any advice welcome.
