I have been called to the magistrates after pleading not guilty to a Section 4a public order offence.
My defence relies on the following. The swearing (at the other party), which added up to "For f***** sake you t***t", was not intended to cause alarm. It was spontaneous and reactionary. It was also within our combined property (of The dwelling), where we both share flats. However I am not sure of the following.
1. Another neighbour was present who has made a witness statement to the effect that he saw me swearing and angry.
2. We were both on the veranda of our property. Does this make us in the premise, or in public?
