I made claim in October of last year through MCOL and the claim was defended a couple of days later. I have had access to the defence on MCOL but was given no options on MCOL to proceed. I have never received the defence in physical form nor received a Directions Questionnaire to fill out.
I chased the court last month and they have replied to say that the case is 'stayed' and that I need to pay £100 to reopen it. I told them I never received a DQ but they're not interested. "£100 or goodbye" they say.
What should be my next move? The claim is only for £400 and I've already paid £35 so far to start the claim. I don't want to pay another £100 only to be told "bye bye". I'd then be £535 down instead of just the original £400 I'm claiming.
