Solicitor using court bundle of documents to submit evidence and hearsay notice late

    Opponents solicitor submitted witness statement late then emailed 2 weeks after witness statement additional evidence in response to my witness statement (no supplementary witness statement with it, no context, not in exhibit form just randomly attached to the email)

    Their reasoning for it being late was that it was in response to my statement but it's not new evidence is stuff that should have been put in the original witness statement

    They haven't provided a hearsay notice either but they say they're putting all of this in a court bundle and as court bundles are to be submitted 7 to 3 days before trial it's perfectly fine to do this late

    I've looked at cpr and it says bundles are only to be swapped if the court directs it which they haven't and the court directions specifically said to exchange at the same date our witness statements and documents
